短期專利

一般而言，在中國香港提交短期專利申請，並無時限。但如果擬聲稱因在巴黎公約國或世界貿易組織成員地區最先提出申請而享有優先權，則須在提交最先申請後12個月內，在中國香港提出短期專利申請。如果發明已予披露，而發明者聲稱該項披露不會損害發明的新穎性，便須在發明披露後6個月內，提交短期專利申請。短期專利保護的有效期最長為8年，由提交申請日起計四年後續期一次。

  所需文件／資料：

  1. 一份說明書(《專利條例》第113(1)(b)條和《專利(一般)規則》第58(2)、59、60及64條)；
  2. 撮錄的中文和英文本(《專利(一般)規則》第61條)；
  3. 申請人的姓名或名稱和地址；
  4. 發明人的姓名或名稱和地址；
  5. 查檢報告－申請者必須提交由下列其中一個查檢主管當局發出的查檢報告，以支持你的短期專利申請︰
    • - 根據《專利合作條約》第16條委任的各個國際查檢主管當局；
    • - 中華人民共和國國家知識產權局；
    • - 歐洲專利局；
    • - 英國專利局。
權利期限： 申請日起4年
首次費用： 港幣7,500元(包括政府費用港幣823元)
續期費用： 核准後每四年繳納一次，提交費港幣4,180元(包括政府費用港幣1,080元)

  1. 須提出一份香港政府認可之機構所作的新穎性調查報告。 (中國大陸、澳洲、奧地利、日本、俄羅斯、西班牙、瑞典、英國、美國或歐洲專利局)
