外觀設計

只有外觀設計擁有人才有權為該設計申請註冊。任何人士藉委託他人創作一項外觀設計，或經由僱聘合約、轉讓等，均可取得擁有權而成為該外觀設計的擁有人。
各種產品的外觀設計均可註冊，包括電腦、電話、鐳射唱片機、紡織品、珠寶和手錶。註冊外觀設計只保護產品的外觀，例如電腦顯示器的外觀。外觀設計的註冊並不保護外觀設計產品的運作方式。產品的運作方式是受到專利法例保護，電腦軟件則受版權法例保護。註冊外觀設計的擁有人有權阻止其他人製造、輸入、使用、出售或出租其外觀設計產品。

所需文件／資料：

  • - 提交一份填妥的申請表格(外觀設計表格第D1號)；
  • - 提交一份該外觀設計的清楚表述；

權利期限：申請日起25年

服務收費：港幣6,000元(包括一項外觀設計政府費用港幣940元)

續期費用：核准後每五年繳納一次提交費港幣3,500元，另加政府費用如下：

  • - 首次延展5年  港幣$1,230
  • - 第2次延展5年  港幣$1,860
  • - 第3次延展5年  港幣$2,740
  • - 第4次延展5年  港幣$4,170
